A Hayward woman faces up to a year in County Jail in connection with a sex act in a public park that proved to doctors that she should not have been receiving workers’ compensation benefits.

On Wednesday, 29-year-old Modupe Adunni Martin, a former custodian for the Sequoia Union High School District on the Peninsula, pleaded no contest to a felony fraud charge in connection with an injury she claimed to have endured in February 2009.

Martin struck a plea deal with prosecutors that includes no prison time but up to a year in jail, San Mateo County District Attorney Steve Wagstaffe said. She is scheduled to be sentenced Dec. 13.

Martin claimed she injured her ankle while on the job. During a three-month period, she reportedly used crutches 10 separate times while hobbling into the offices of two different doctors.

After suspicions arose about her condition, an insurance fraud unit used an undercover investigator to film Martin’s activities. At one point, Wagstaffe said, Martin was filmed changing into a pair of high heels after a doctor visit and then engaging in X-rated activity with her boyfriend in a nearby park. Doctors said the encounter could not have been accomplished with the type of injury Martin claimed to have.
