A Vallejo man facing life in prison for allegedly shooting a Daly City man in the face last month was reportedly reacting to allegations that the victim had been abusing his own niece, according to prosecutors.

Luis Alberto Gutierrez Jr., 27, was arrested in Vallejo after the grisly Aug. 19 shooting at the victim’s apartment on Wolfe Avenue in Daly City, police said. Gutierrez was suspected of attempted murder and burglary, prosecutors said, after allegedly shooting the victim in the jaw while aiming at his head.

Further investigation revealed that Gutierrez had a clear motive to kill, San Mateo County District Attorney Steve Wagstaffe said. Gutierrez had been dating the victim’s sister, Wagstaffe said, and was reacting to allegations that the victim had been abusing his niece.

On the day of the shooting, the victim reportedly allowed Gutierrez into his home even though Gutierrez was wearing a backpack, gloves, sunglasses and hat. Gutierrez asked to use the bathroom, Wagstaffe said, and emerged with a gun .

He “walked up to the victim and shot him in the head, striking him in the jaw,” Wagstaffe said. The victim charged at Gutierrez, the district attorney added, and dodged two more shots.

Gutierrez is scheduled to enter a plea Oct. 24.
