Daly City stepfather who beat son for skipping nap to be sentenced 

The Daly City stepfather who beat up his 5-year-old stepson because he wouldn’t take a nap is scheduled to be sentenced Wednesday.

Michael Demata Miguel, 30, pleaded no contest to felony infliction of injury on a child on Aug. 29. He will serve no more than a year in county jail as part of the plea bargain.

Doctors were alarmed when the boy was brought to Seton Hospital in April of last year, according to San Mateo County District Attorney Steve Wagstaffe. He was vomiting blood and complained of stomach pain. The doctors found he had pancreatitis and numerous bruises to the right side of this body, Wagstaffe said.

The boy’s mother claimed the boy was clumsy and fell often. But police and child protective services established that Miguel had beaten the boy when he wouldn’t take a nap, Wagstaffe said.

Miguel “struck victim in stomach and chest area, causing victim to fall backward onto a television rack,” the district attorney said.

The defendant has been out of custody on a $50,000 bail bond.
