A lawyer wrote this nonsense? "you have left the state of California — and even the United States." Really? Passionate advocacy is great, but it's no excuse for broadcasting pathetic ignorance.
ALL laws of the United States of general applicability apply to Indian tribes. Read the US Constitution, Article 1, Section 8, Clause 3! Then check out Title 25 of the United States Code. Furthermore, ALL criminal laws of the State of California apply to Indian tribes and to all people on Indian lands and ALL federal and California law enforcement officers have full authority on tribal lands. Yes, ALL.
It is true that Tribes are quasi-sovereigns but they are ABSOLUTELY subject to the power of Congress, the President, and the US Supreme Court. I hope the SF Examiner will allow equal space for a rebuttal of this hostile, ill-informed piece, which is clearly intended to do nothing except advocate for the position of this lawyer's client, and, probably, to generate more business for the law firm.
