The author of the article seems to have a short memory... He makes a bold statement that "Here's the problem: In this country, we like our competitions to be decided on the field, not in the courtroom."
He seems to forget that in July 2007, Oracle Team (then called BMW Oracle) filed a lawsuit in the New York supreme court because in their view the rules set by then America's Cup holder, Alinghi, were unfair. They won in the courtrooms which then gave them the right to face Alinghi on the water. They, deservedly, won on the water in February 2010.
