The sound of music and revelry will be allowed to continue bellowing from an illegal terrace above a Mission district restaurant.

Neighbors of Medjool Restaurant and Lounge, near Mission and 21st streets, complained to The City about noise from the popular rooftop terrace.

The terrace violates city law, but the Planning Department won’t fine the restaurant because the owner is working to bring it into compliance, City Planner Craig Nikitas said Wednesday during a Board of Appeals hearing on the matter.

A proposal by the restaurant to reduce the terrace’s size and introduce soundproofing could be heard by the Planning Commission before May, Nikitas said.

Plans are still being refined based on feedback from Planning Department officials, neighbors and an acoustics consultant, Medjool’s attorney said at the hearing.

The Board of Appeals on Wednesday did not order the terrace to shut. Instead, the board voted 3-2 to reconsider the matter after the Planning Commission has reviewed plans to redesign and soundproof the terrace, effectively allowing it to continue operating illegally.
