Colorado union balks at rules on teacher arrests

WHAT: A Colorado union sued to challenge a requirement that school officials notify parents when teachers are arrested on suspicion of or charged with sexual assault, child abuse or indecent exposure.

BACKGROUND: The rules were adopted by the Board of Education after a newspaper investigation revealed officials were disregarding a law requiring notification to school districts of such incidents.

WHY: The Colorado Education Association claimed the requirement is “arbitrary,” “vague” and constitutes an “abuse of or a clearly unwarranted exercise of discretion.” The union wants a judge to overturn the rules.
