Gun control restricts those least likely to commit violent crimes

The March 21 murder of four Oakland police officers by Lovelle Mixon, a convicted felon wanted for a recent parole violation, epitomizes the futility of “gun control,” or the banning and restricting of gun ownership for law-abiding adults. Using the officers’ tragic deaths to further an unrelated agenda — stripping away the Second Amendment rights of honorable citizens — is both harmful and distracting.

Mixon was not an anomaly. Felons commit over 90 percent of murders, with the remainder carried out primarily by juveniles and the mentally unbalanced. The United States already has laws forbidding all three groups from owning guns, which, by definition, are ineffective against the lawless. “Gun control,” therefore, only “controls” those who have done nothing to merit such regulations.

Arguments for gun control rest on deceptive claims such as National Coalition to Ban Handguns’ allegation that “most murders are committed by previously law-abiding citizens.” Americans are deluged by literally dozens of supposedly scholarly articles asserting such falsehoods — but with no supporting references. For there are none.

Notably, only 15 percent of all Americans have criminal records, yet more than 90 percent of murder suspects have a history of crime. Their criminal careers average six or more years’ length, including four major adult felonies, in addition to their often extensive juvenile records.

A New York Times study of the 1,662 murders in that city between 2003 and 2005 found that “more than 90 percent of the killers had criminal records.” Baltimore police records show similar statistics for its murder suspects in 2006. In Milwaukee, police reported that most murder suspects in 2007 had criminal records, while “a quarter of them [killed while] on probation or parole.” The great majority of Illinois murderers from the years 1991-2000 had prior felony records. Eighty percent of Atlanta murder arrestees had previously been arrested at least once for a drug offense; 70 percent had three or more prior drug arrests — in addition to their arrests for other crimes.

In sum, guns or no guns, neither most murderers nor many murderers — nor virtually any murderers — are ordinary, law-abiding, responsible adults. This conclusion is so invariably reached by homicide studies that the 1998 study by David Kennedy and Anthony Braga describes the fact that murderers are almost invariably veteran criminals as a standard “criminological axiom.”

Naïve, well-meaning people often respond to such facts with, “Still, wouldn’t this be a better world without guns?” After many years of studying guns as a highly effective method of self-defense, I reply, no, the world would be immeasurably worse off without the only weaponry that gives the weak a real chance against predators. After all, there was a time, hundreds of years ago, when there were no guns. Without guns for self-defense, survival was measured by the strength of men’s arms, as women, children and the elderly huddled in terror, escaping only by abject submission to their predators. Yes, Mixon used a gun to kill four Oakland police officers. But had he not been shot and killed by another member of the SWAT team, the death toll would have been undoubtedly higher. In the hands of sworn officers and moral citizens, guns are a powerful, swift means of protection. When the government passes laws that only peaceable people obey, they are simply leaving the same people at the mercy of violent predators.

I don't like guns but I usually agree with this argument. Stronger gun control laws sound great, but the people we need to worry about are criminals. If they didn't obey the laws that were already on the books, tightening them won't have any effect.

Thank you, Examiner, for publishing the Op Ed by Don Kates on the misguidedness of gun control. At last, a voice of reason. As Mr. Kates points out, the facts are that the problem of gun violence is the criminal. Within three years after England banned and confiscated all legally owned firearms, gun violence increased by 40%. Since the law-abiding public was left disarmed, only the criminals still had guns. It is emblematic of our political and social foolishness that San Francisco politicians seek to shield from immigration prosecution illegal aliens who commit crimes.

There is so much data to back and affirm what this article reports. 38 States have shall issue, and the old fear mongering claim of blood in the streets, is firmly rebuffed by the truth and facts. Those willing and able to go through the process to obtain a concealed carry permit, are indeed the least likely to commit a crime with a gun. The time, scrutiny, and cost to obtain a permit is significant. Lets not loose sight of the fact that, we are all entitled to self defense, it is our RIGHT, not a privileged. Your safety, and the safety of your family is your responsibility. The Supreme court has already ruled that law enforcement has no responsibility to protect the individual, only the general public. I would suggest that people who may disagree with this article do the research on concealed carry, in shall issue states, and form an opinion based on facts, not fear.

Thank you for publishing an article that finally looks at the root cause of so much misery in our society: the criminal. We should focus our preventative measures on the criminal rather than the tool they use in their murder sprees. Unfortunately, that's a tough job, and doesn't provide a false sense of immediate action that those who hold public office so often seek. The facts exist in overwhelming numbers: gun control does not keep criminals from any illegal activity, but does in fact harm innocents who cannot defend themselves. Thank you for even this small effort in bringing the truth to the every day reader.

Great article, thank you for getting to the root of the problem, which is criminal behavior, and not an inanimate object - the gun. The gun can be just as easily used for good (to stop a crime) than to commit a crime. Spot on!

Well said. The scholarly research (and lack thereof on the anti-gun side) is out there. Mixon chose to break the law long before he ever put 1, let alone 4, police officers in his sights. Felony incarceration, parole violation, possession of weapons and ammunition by a convicted felon, (likely) illegal purchases of guns and ammunition and on and on. Punishing those who abide by the law to control those who ignore it in the first place makes about as much sense as saying spoons make people fat.

Thank you Don for writing a coherent, well reasoned editorial on the fallacy of "gun control". Obviously the anti-gun lobby cannot stand to look at the facts of criminals and gun crime. They have to sensationalize shootings and call for gun bans to eliminate these tragic events. There is more than enough evidence to show that states that support gun ownership by law-abiding citizens have lower rates of gun-related crimes. If our government could focus on enforcing existing laws to restrict the flow of guns to criminals, we might actually see some progress in reducing gun crimes.

But don't forget, the anti-gun groups scare us with numbers like "32 people killed every day in a crime committed with a gun," but don't share the DOJ's own statistics that say that guns are used for legal defensive purposes more than 1.4 million times a year (4100 times per day!) and in the vast majority of those situations, a shot is never fired. If such groups really cared about "saving lives" they would address this. But it's not about saving lives at all, is it?

You too have a right to LIFE, LIBERTY, and the pursuit of happiness. I capitalize LIFE, and LIBERTY because without our right to keep, and bear arms we have no right to both our lives, and liberties. Well said. Hope some people will be persuaded. It's an old saying, but gun control worked quite well in Nazi Germany, Russia, China, etc. While guns are to protect innocent citizens from crime, they also serve as a kind of check and balance against governments. On the other hand, an unarmed population can be pretty much rounded up and dealt with however the people with the guns (government) decides

It seems that a world without guns is as dangerous as with. Especially when presented by a person of law. I keep thinking that each thinker of the law passes a judgment that has to be balanced or it is useless. The talk of the criminal overshadows the victim. A victim which is lesser and at the mercy of the predator. In the case of a criminal who is killed, he or she becomes a victim does the protector become the predator. I think not. A violent predator is that. A violent predator, no amount of syntax, parable, or as some would say, 'smooth talking' changes the final word. A gun is very destructive force. It was not created for protecting the weak because it used mostly by the criminal strong. I agree with some of the comment but I find the distance from the 'target' very educated.

You aren't born a criminal so obviously every crime is committed by "previously law abiding citizens." Suprising that this is coming from the SFX, good stuff!

Excellent article! I think that we would be better off if NOBODY had guns, but that is impossible. If guns are made illegal, there would be no way to completely get rid of them, and we'd be lambs led to the slaughter. I have a CCW permit but I carry mine openly (in Ohio) not because I like it, or I think its cool, but because I've been mugged at gunpoint by a seriously deranged dude who looked like he was going to flip. I wear my gun on the outside as a deterrent. If gun carriers were ubiquitous, I wouldn't need to wear it openly, as felons would never know who had one or not.

Great article which sums up in few words the lack of real substance of most gun control arguments. In Idaho, were guns are very little regulated, we enjoy a low crime rate. For sure, the fact that many people can defend themselves with guns is a relevant factor.

Excellent article, and I applaud Don Kates and the Examiner for publishing it. The really disturbing thing IMO is that it even needs to be published. Its reasoning is clear and its conclusion so self-evident no rational person would doubt it, even without the statistics. Clearly the "gun control" freaks fall into two groups: people who have an ulterior motive for disarming our citizens, and the useful idiots who parrot (and I must presume, are too stupid to doubt) their faulty logic. We will see soon enough the first group's motive is the same as that of Hitler and every other tyrant who did the same thing throughout history: to enslave the masses. Armed citizens tend to oppose tyranny so it is essential for any would-be tyrant to persuade his intended "subjects" to lay down their arms. The Founders of this Republic counted upon citizens to have better sense than to be so deluded. To those who love Liberty I implore you: please don't let them down.

Wait a second. Toronto Canada, a city of 3.5 million people, averages 40 murders a year. Look at major cities in Japan and other places in the world with very tight gun control. They all have one thing in common, a very low murder rate. Now look at American cities. we have very very high murder rates,and you can buy a gun here, and own one. And where do these peole get all these guns, the felons, they steel them from people, law obiding people. I am for the right to own a gun, but be honest in your opinion, tell the facts, and the facts speak for themselves. Places with tight gun control have lower murder rates, much much lower. You said look at England. OK, look at London, a large city, look at their murder rate with very tight gun control, now look at New York City. 100 times higher. hmm.

One nitpick. All laws are written on the assumption that the law-abiding will abide by them, adn the lawless won't. What makes gun control laws and laws against self-defense so horrifying are that they render the law abiding helpless in the face of those who do not obey the law, or would pervert the law. A law against murder, rape, or robbery does no such thing.

For CK: Actually, studies show that there is very little relation between the number of guns in a society and the murder rate. What does happen though is that if criminals still have (illegal) access to guns (and please don't say "confiscate them" - do you have any idea how unconstitutional the laws would have to be to pull THAT one off?) and regular people don't, the criminals have a huge advantage. Even in places like england, the criminals are getting away with robberies and such with chains, bats, knives, etc. and by using groups of robbers, because youth, strength, and numbers are VERY effective against anyone without firearms,

I have a response to "Chris Kapsalis". The reason you see such low murder rates in cities in Japan isn't because of bans on gun ownership. It's a factor of a culture which emphasizes 'getting along' and conformity above all else. Japanese live their lives bounded by strict rules of behavior, duty and society. Yes, the murder rates are low, but Japan's suicide rate is 3 times that of the US! If you want a more realistic look at what banning gun ownership results in, look to Australia: In 1996, Australia banned all handguns and most long guns. Since that time, armed robberies have increased 45% and, in the state of Victoria, gun homicides have climbed 300%!! It took only six months after the gun ban for Aus to experience its first EVER home-invasion robbery. Those are the real statistics on what a gun ban accomplishes.

um... gun control works. You have to control it all the way (which we've never done). If certain states ban guns and others don't, then criminals just cross the state lines to get weapons. Then the conservatives say, "See? It doesn't work!" Ask Japan how gun control works. They have less than 50 murders per year. Republican policies lead to more poor people, which leads to more crime, which leads to more violence. So either ban guns, or change your policies on the economy. I know that's a tough one for you guys, because you base your whole life around your money and guns.... You're such idiots

"oh please" Gun control does NOT work. Prisons have absolute gun control. You know what the inmates do? They manufacture guns *and* ammunition. 100% gun control does not mean no guns. Criminals know how to make zip guns, pipe shotguns, and pipe bombs (which are banned). As for statistics, read the above comments before you quote useless numbers that are more an indicator of basic societal difference than the present of inanimate objects. Think!

The group least likely to commit crimes is the group that does not have any guns. Gun laws only affect gun owners. Most guns used by criminals were originally owned by law abiding citizens. The more guns the law abiding public has the more guns criminals have access to. How do you keep guns out of the hands of criminals?

First off, Japan has more than 50 murders per year - In fact it is 10 times that. BUT even that is still low. What Japan does not have that the USA is stuck with are millions and millions of illegal immigrants who are often career criminals and gang members.

For Bombreno. I am in favor of Americans having the right to own and bare arms. Actually In my opinion CA is way over the line of our American freedoms. But do not use junk science, lies, leave out inconvient turth etc to make your case. I only pointed out that IMO we would have a safer country if we took away all the guns. But that too IMO is way too high a price to pay for being less free. Our freedom comes with a price, and one price amoung many is that we will be less safe sometimes. Tornot has about the same demografic make up as Chicago, abot the same number of people, yet it's murder rate is vastly lower than Chicago. We= could aslo have the national guard or miltary partollling the street, checking our papers, have a curfew to be a little safer, but hell no. I am pro gun anti BS. And the truth is gun control makes us a little safer, in the long run, but I would rather be more free and less safe anyday

So true. The article makes complete sense and I couldn't agree more. Obviously, tightening gun control laws will simply worsen criminal acts because this way you're leaving the law abiding ones without defense! whereas the criminals anyway don't care what the law is.
