The men who sold a lost iPhone 4 prototype to a technology blog for $5,000 will not serve any time in jail, but they each owe $250 to Apple after pleading no contest to a misdemeanor theft charge on Tuesday.

Brian John Hogan, 22, of Redwood City, found the prototype at a Redwood City bar, where an Apple engineer had left it, and then Hogan and pal Sage Robert Wallower, 28, of Emeryville sold it to Gizmodo blogger Jason Chen, prosecutors said.

On Tuesday, Hogan and Wallower struck a plea deal with prosecutors on a single misdemeanor count of theft of lost property. Along with a payment of $250, they were each sentenced to a year of probation and 40 hours of community service, San Mateo County District Attorney Steve Wagstaffe said.

Prosecutors had asked that the men receive five days in jail, but the judge gave them none, Wagstaffe said.
