Sanctuary policy fight heats up

Battle call: Mayor Gavin Newsom promises to kill sanctuary policy legislation even if it’s passed veto-proof. (courtesy photo)

The controversial proposal to alter The City’s sanctuary policy for illegal immigrant youths will receive its first public airing today during a hearing at City Hall.

San Francisco’s sanctuary policy was established in 1989 and is meant to foster an environment in which illegal immigrants feel safe to report crimes, access city services and engage in local government without fear of deportation. After a public back-and-forth between city officials about whether altering the policy to stop reporting some illegal immigrant youths will help or hurt The City, the decision about its future will be made by the Board of Supervisors.

Last year, it was reported that The City was shielding undocumented youths convicted of felonies from deportation.

That revelation prompted Mayor Gavin Newsom to change the policy so that all illegal immigrant youths who are arrested on suspicion of a felony are released to federal authorities.

But legislation introduced by Supervisor David Campos would partially roll back Newsom’s changes. The proposal would not allow local law enforcement to report youth offenders unless they are convicted of the crime or are being charged as an adult.

The legislation has created one of the biggest political fights of the year. Newsom has promised to veto it, even if the supervisors have the eight votes to overturn his veto (eight members of the board continue to support the legislation).

Newsom spokesman Nathan Ballard said the mayor opposes the legislation for “three main reasons.” Not only does Newsom disagree with using the sanctuary policy to “shield criminal behavior,” he does not want to put “the entire policy at risk,” since the legislation is likely to result in a legal challenge, Ballard said.

Furthermore, even if the legislation passes it’s most likely unenforceable, he said.

Campos rejects Newsom’s fears that the legislation would jeopardize The City’s sanctuary policy overall. It’s defensible in the courts, he said, noting that Newsom has supported same-sex marriage and health coverage for all, both of which San Francisco is now fighting in court. The threat of legal challenge is no reason to not afford youths “due process,” Campos said.

His legislation comes at a particularly sensitive time for Newsom, who’s put himself in the running to be California’s next governor.

Newsom also held a private meeting with San Francisco’s top officials Wednesday to discuss the legal threats surrounding the sanctuary policy. It does not appear that the meeting prompted any of the supervisors to change their votes on the legislation.

Future of controversial policy

Supervisor David Campos’ plan would change reporting rules for youth offenders.

  • Proposed legislation would allow local law enforcement to report illegal immigrant youths arrested on suspicion of a felony only if they are convicted or charged as an adult
  • The three-member Board of Supervisors Public Safety Committee discusses the legislation today
  • If the committee approves it, the legislation could be adopted by a Board of Supervisors vote Oct. 20

Our Government, past & present, Republican & Democrat, have allowed the invasion of 20 to 30 million criminals and uneducated peons which is the largest invasion of any Nation, at any time, by any means & in direct violation of Article IV, Section IV of our Constitution.

This refusal to abide by our Constitution or enforce our Immigration Laws should be classified as Treason of the most foul kind, & as grounds for impeachment & trials for Treason!

Not only have they allowed the invasion, they force American tax payers to pay Billions on Billions of dollars to provide Welfare, Prison cells, Educate the invaders numerous children, and free medical care, at the same time the invading horde break numerous laws and massive document fraud, & are destroying our schools, hospitals, communities, culture and standard of living while Robbing, Raping, Killing & Assaulting American Citizens WAKE UP PEOPLE!

"The proposal would not allow local law enforcement to report youth offenders unless they are convicted of the crime or are being charged as an adult." I am sorry but if the Police arrest you, even before formal charges etc, I would suspect that there was a very good reason the Police took action. Of all the cities in the USA (and even the world) our police force will look twice...or even three times...before pulling out their book to write up an arrest. Take it from someone who see's it every day in the SOMA. At least it was take way before the current Chief. Why do we have laws if they are never enforced. If we send a message, a consistent message that our City's law enforcement will enforce the law 24/7 that in and of itself will go a long way to tell the criminals "don't bother to come to our City to do crime". Be it from the north bay, south bay, east bay or overseas.

What is the matter with America today?
The U.S. belongs to the citizens of the United States.
Why are we allowing this invasion by Mexico?
All illegal aliens should be rounded up.

Sanctuary policies have invited this problem into our communities. Why are there TWO sets of laws? One for illegal immigrants that allows them to commit crimes daily with impunity and laws for everyone else? Why should illegal immigrants be given more consideration under the law than American citizens?

This is insane! ALL LAWS NEED TO BE ENFORCED FAIRLY FOR EVERYONE. If you are committing a crime, it shouldn't matter what color your skin is or where you came from.

whats is the chance that a sf city official is wrapped up with gangs illegally and getting money to protect juvenile gang members who are illegal-hiding behind the stupid sanctuary "policy". Ask more of us what we think of the policy. go ahead.

This is happening all over the country and in many places the cops actually say publicly that they will not arrest illegals no matter what they do. Many documents written by people who consider themselves globalists talk about how Spanish speaking people are to be given priority over Americans. This is public knowledge, not conspiracy theory!

Anyone that commits a crime should be prosecuted regardless if they are US Citizens or Undocumented Immigrants.

Vote out every last Supe. They're more concerned with shielding illegals than the safety of San Franciscans.

Que, sera, sera, the new mantra of San Franciscans. What will be will be. We will allow our leaders to do whatever they want to do. Even if it means allowing drug dealers, gangs, and gang members to kill innocent people in broad daylight, on the Streets of San Francisco, as happened to the Bologna family, long time residents that the liberals in Frisco, let down in the cruelest way imaginable.

I agree. And part of the punishment that illegal aliens should receive if they are found guilty of committing a crime is to be deported after they finish serving their time in jail or prison.

Hey San Franciscans! If you want to see the fruits of a liberal illegal immigration policy, come down to the third world country known as Los Angeles! Come down and see what's in the future for SF!

Sanctuary City--Liberal/Socialist Mayor Gavin Newsom for the new Governor of the State. This would be an absolute atrocity to the legal communities, when Newsom allowed ID for illegal aliens and refused to put young illegal immigrant gang members in the hands of ICE? Indirectly the sanctuary policy that was indifferent to Federal law, was an accessory in the June 22 slaying's of Anthony Bologna and his sons Michael and Matthew. There is already a mayor in Los Angeles who supports the illegal immigrant invasion, so you definitely don't want Gavin Newsom giving bogus identification or welcoming millions more illegal families to extract subsidies from the already cash-strapped Californians.

This is great news! If San Francisco's serious about the sanctuary city policy, if it's truly "designed to protect our residents, regardless of immigration status," as Newsom says, then that status must include due process under the law. "Criminal behavior" should be decided in the courts, and not by the color of someone's skin. Plus, keeping families together and communities intact is vital to maintaining public safety in SF. Good job!

Que sera sera, huh, Concerned resident. Your concern must be towards foreign nationals in the nation and city of Frisco illegally. San Francisco's citizens you obvioulsy don't care about. No matter, decisions have consequences and bad decisions have bad consquences. You leftists won't escape this iron clad law of reality no matter how smart you think yourselves.

The Redskin Redneck

Only the certifiably insane, and far left would vote in Newsom as Governor. What's been happening in beautiful Frisco, since these leftists have gained power there, is so tragic, so unbelievably tragic. Wherever leftist Democrats gain power, everything they touch or become involved in-- EVENTUALLY LEAVES UTTER RUIN BEHIND. Whether it's life long welfare victims with no sense of dignity, or family members murdered in broad daylight in the beautiful city of San Francisco.

Gavin Newsom's sanctuary city policy is destroying San Francisco, and it's time for the concerned citizens to take action. Just look at the crimes that have been occuring and how illegal aliens are caught and let off only to be allowed back into the community to commit more crime. This isn't rocket science and the whole santuary city policy needs to be revoked if SF is going to retain it's charm and appeal and get control of the crime. Look at what's going on in Oakland if you want any proof what's going on, particularly with the Norteños vs. Sureños and other gangs fighting for turf. It's out of control!
