Illegal immigrant fights S.F. drug charge

SAN FRANCISCO — A San Francisco jury found a 23-year-old illegal immigrant guilty Friday of selling crack cocaine in the Tenderloin despite his claims that human traffickers forced him to do it.

The case pitted the issues of human trafficking versus illegal immigrants who commit crime in the sanctuary city of San Francisco. While it is common for illegal immigrants to claim they are blackmailed into a life of crime, the cases rarely go to trial.

After what jurors described as about seven hours of intense and at times heated deliberations, an applause came from the jury room as the decision was made.

Jury foreman Daniel Ludwinski said he was one of the last to hold out against finding Rigoberto Valle guilty, but in the end he just didn't believe the Honduran immigrant's story.

I had sympathy for him because at some point he was victimized, Ludwinski said. "It all came down to whether or not we could trust the defendant."

Police arrested Valle in an undercover “buy-bust” operation at Larkin Street and Golden Gate Avenue on June 4. Plainclothes officers gave Valle $20 and he spit out two rocks of crack cocaine in return, according to the charges.

Valle, who listened to the trial through an interpreter, claims he was the victim of human trafficking and was forced to sell drugs in order to pay a $500 debt to a smuggler. His attorney, Deputy Public Defender Hadi Razzaq told the jury on Thursday that the smuggler, also known as a “coyote,” put a knife to Valle’s throat, forcing him to sell drugs.

This happened after an arduous desert journey from Mexico to Arizona in which his family member paid a $1,500 fee. His trip to San Francisco would cost him another $500, which he couldn’t pay.

Prosecutors said the trafficking defense is just a way to avoid going to prison. If the jury believed his story, it could have sparked a defense with the potential to allow illegal immigrants to deal drugs with impunity. 

Assistant District Attorney Richard Hechler, in his closing statement, said Valle’s story is unbelievable because he always had a chance to escape.

“He could have run. He should have run. He didn’t run,” Hechler said.

Valle could be sentenced to prison but will most likely end up with probation. He will face deportation, however, because authorities believe he is in the country illegally.

Our Government, past & present, Republican & Democrat, have allowed the invasion of 20 to 30 million criminals and uneducated peons which is the largest invasion of any Nation, at any time, by any means & in direct violation of Article IV, Section IV of our Constitution.

This refusal to abide by our Constitution or enforce our Immigration Laws should be classified as Treason of the most foul kind, & as grounds for impeachment & trials for Treason!

Not only have they allowed the invasion, they force American tax payers to pay Billions on Billions of dollars to provide Welfare, Prison cells, Educate the invaders numerous children, and free medical care, at the same time the invading horde break numerous laws and massive document fraud, & are destroying our schools, hospitals, communities, culture and standard of living while Robbing, Raping, Killing & Assaulting American Citizens WAKE UP PEOPLE!

this is ridiculous, he never would have had to sell drugs if he didnt CHOOSE to come here illegally in the first place.....i wonder how much money we have to waste now with trial costs, imprisonment costs, the cost to send him back to honduras........sweet deal lets keep letting illegals invade our country, afteer all we do need more MS 13 and drug dealers in the state

The city of SF has hung out the "Welcome illegals" sign with its sanctuary city policy. Other states/cities should hang their sign, "Move to San Francisco".

It's amazing, there are Americans trying to figure out "how did our country get this way?" When all they need to do is read this story. The city of San Francisco, and it political base is the seed that will start a revolution...

Based on what I read, I'm sure no one in inSane Francisco has read "A Tail of Two Cities" The leaders better, because somewhere in that city, their are the Madam Defarges' and Miser Dufages'... and I'll bet she, Madam Defarge, is knitting a shroud for the politicians and insane Judges right now... I'm sure that Mayor Newsom, Nancy Pelosi, Senator Dianne Feinstein, and Senator Barbara Boxer will be part of the entertainment...

San Francisco liberals love illegal aliens. The more violent they are, the more they love them. Too bad for you San Franciscans that you allow this stuff to go on, it's only going to affect you--sooner or later. Remember the Bologna family? I doubt any of you liberals do. Frisco's a nice place except for--illegal alien gangs running around everywhere, the smell of urine on the streets, dirty motels, bums hanging around and begging everywhere, communist book stores, and prostitues. Other than this, it's a "nice place". The liberals have done a bang up job. I'd continue to vote them in, anyday.

If you believe that you should be forced to live in San Francisco. All one can say is that the liberals, Newsom, Boxer, Feinstein, Pelosi, and those liberal democrats in Sacramento made their choice, didn't they? They picked allowing the gang scum to stay on the streets and kill the Bologna family members. IF THIS SOUNDS HARSH, EXTREME,ETC. THAN WOULD SOMEONE PLEASE GIVE ME A BETTER EXPLAINATION FOR WHO IS RESPONSIBLE. THE GANG SCUM WAS KNOWN TO BE A VIOLENT PERSON WITH EXTREME CRIMINAL TENDENCIES.P.S.
