An Occupy San Francisco protester chose jail time over community service and probation during his Thursday sentencing for misdemeanor vandalism.

Richard Barksdale, 43, of Colorado Springs, Colo., an activist who’s been arrested at least three times this year during protest-related incidents, was found guilty of writing on the walls of the vacant Cathedral Hill Hotel on March 25.

During his sentencing, Superior Court Judge Lynn O’Malley Taylor gave Barksdale the option of no jail time as long as he committed to, among other penalties, 100 hours of community service, two years of probation and counseling.

Barksdale said he did not want probation or community service, but rather a jail cell.
He was sentenced to 30 days in jail and no probation, prosecutors said. Prosecutors called the judge’s decision too lenient.

Barksdale’s troubles are not over yet. He still faces misdemeanor trespassing and vandalism charges related to the Occupy takeover of the vacant building at 888 Turk St. in April. In that incident, prosecutors said, Barksdale wrote his nickname, Dr. Love, on the wall.

Police reportedly saw Barksdale writing graffiti that caused $1,200 in damage.

He is next scheduled to appear in court July 6.
