The husband of a man killed by a Muni bus on Mission Street last year has filed a wrongful-death lawsuit against the transit agency.
Scott Whitsett, a 49-year-old San Francisco resident, was killed on April 21, 2010, after being struck by a 14-Mission bus while crossing Mission Street.
On Monday, Theodore Glaza, Whitsett’s husband, filed a wrongful death suit in San Francisco Superior Court, accusing Muni of carelessness and negligence in the incident.
According to Glaza’s civil complaint, the operator of the 14-Muni bus, Kimberly Faye Johnson, was unwrapping a candy bar and distracted at the time of the incident. When she saw Whitsett crossing in front of her, she mistakenly hit the accelerator on the bus, instead of the brake.
By inadvertently speeding up, Johnson struck Whitsett, with the impact pinning him against a second Muni bus, killing him, Glaza’s complaint alleges.
Whitsett was a lawyer and community activist who had worked for Lexis Nexis from 1998 up until his death.
