Anticipation is swirling over what will happen next in the domestic violence investigation of Sheriff Ross Mirkarimi while Mayor Ed Lee reviews what his responsibilities will be in the event that criminal charges are filed.

“I have to be aware of all my duties,” Lee said, declining to go into greater detail about the situation until a decision is made on whether to charge Mirkarimi with a crime.

Mirkarimi was accused by Ivory Madison — his neighbor and political supporter — of bruising his wife’s arm during a New Year’s Eve spat at the couple’s San Francisco home. Eliana Lopez, Mirkarimi’s wife, denies that any violence occurred, but police seized video and text message evidence of the alleged abuse last week from Madison, who notified authorities after Lopez apparently went to her for help.

The incident is under investigation by the District Attorney’s Office, which is expected to make a decision soon on whether to file charges against Mirkarimi.

Lee said while it’s “very tempting” for him to answer questions about the circumstances, he will refrain from commenting until he hears more from the DA. The mayor added that the allegations have created a “serious situation” that is causing anxiety in the public and at City Hall.

“I think everyone is anxious to hear what the DA has to say,” Lee said.
