Man faces year in jail for fatal Pacifica hit-run

The man who fled a fatal Pacifica car accident — returning only after his insurance company advised him to — faces up to a year in county jail when sentenced Jan. 25.

Leopoldo Tobilla, 58, of San Bruno pleaded no contest Monday to felony hit-and-run and misdemeanor reckless driving involving alcohol.

After leaving a party Feb. 20, Tobilla struck 25-year-old pedestrian Scott Garrigan of Pacifica in his Mercedez on state Route 35. Garrigan was allegedly intoxicated and illegally crossing.

Though Tobilla was not found at fault in the accident, he fled the accident scene and returned only after his insurance agent told him to.

Tobilla claimed he had only had one beer, but investigators said he appeared intoxicated.

Tobilla’s blood alcohol level tested at .06 about an hour after the accident, below the legal limit of .08.
